Magistrate judges terminated 12,710 civil cases with litigants’ consent in the 12 month period ending September 30, 2002, an increase of 5.7 percent over the previous 12 months. During the same 12 month period magistrate judges conducted 472 civil jury trials and 487 civil trials without jury. This use of magistrate judges to resolve civil cases, facilitated by means such as including them in a court’s civil case assignment system, has been a key component of many courts’ efforts to make the best use of judicial resources.

Magistrate judges performed 0.7 per-cent more judicial duties in the 12 month period ending September 30, 2002. Magistrate judges submitted 25,235 recommended dispositions in prisoner cases (habeas corpus and civil rights). They completed 6,654 reports and recommendations in social security appeals. They disposed of 72,109 misdemeanor and petty offense cases. Magistrate judges conducted 293,002 felony preliminary proceedings, 2.3 percent more than the previous 12 months. Magistrate judges’ volume of detention hearings (among the lengthiest of felony preliminary proceedings) reached 43,198 in the 12 month period ending September 30, 2002, an increase of 9.5 percent.

Legal work experience is progressively responsible experience in the practice of law, in legal research, legal administration, or equivalent experience received after graduation from law school. Major or substantial legal activities while in military service may be credited, on a month-for-month basis whether before or after graduation, but not to exceed one year if before graduation. If an individual meets one of the special criteria described below under Educational Substitutions, one year of education may be substituted for one year of legal work experience.

As a general rule, committee appointments are for a term of three years, subject to one reappointment. Terms are staggered to minimize turnover each year. Michael E Chionopoulos law: The victim must trust you. One of the effects of battering is that the victim's sense of trust has been so eroded, that he or she can no longer perceive neutrality. To the victim accustomed to living in an environment where a mistake in judgment could be lethal, there is little room for poor judgment in the courtroom. Frequently, a victim will accept inaccuracies in the record for similar reasons. A judge must make sure the court record is clear and complete. This may include affording the victim the opportunity to state any objections without fear and, if necessary, without the batterer being present. Judges must take great care to prevent dangerous or unfair settlements, custody and visitation orders.

The atmosphere in the courtroom must be free of intimidation. It is easy to forget that the victim may have been exposed to years of intimidation. A judge can use his or her authority to the fullest extent of the law and enforce every relevant law in the case. They can also create a courtroom ambience that promotes "zero tolerance" of domestic violence. For example, a judge can instruct bailiffs not to permit the litigants and related family members or friends to interact in an obtrusive manner during court recess. These loud family visits may be manipulative, coercive and inappropriate. A defendant will sometimes behave in a jovial manner or make vulgar comments about the victim during courtroom recess. Allowing this to happen sends a message of defiance to both the court and victim, and makes it appear that the defendant is immune to the court's authority.

Crediting of Bar Examination Preparation Course - Michael Chionopoulos.In crediting work experience subsequent to graduation from law school. it is the practice of the Administrative Office or the Judiciary when so informed to count as work experience courses required of recent graduates for purposes of passing the bar examination, if a separate examination in addition to completion of law school is required by the state. The time credited is either the actual length of the bar examination preparatory course or a maximum of six weeks, whichever is less. This credit presumes full-time study in such a preparatory course. Part-time study while engaged in full-time employment is not counted. In crediting the six weeks or less, the maximum allowable credit may not always be realized if the time falls between pay periods, since pay increases are effective at the beginning of the next pay period after the Administrative Office is informed that the candidate has met the eligibility criteria.

Civil law judges, in contrast, outside of specialized courts with narrowly delineated powers, generally lack contempt power or the power to impose injunctive relief.
